An individual was apprehended Thursday, June 5 — by the U.S. Marshal Carolinas Regional Fugitive Task Force — in relation to May 31 fatal shooting on Kathy Road in western Burke County.
An individual was apprehended Thursday, June 5 — by the U.S. Marshal Carolinas Regional Fugitive Task Force — in relation to May 31 fatal shooting on Kathy Road in western Burke County.
Two Morganton men and a juvenile are facing charges for their involvement in the shooting on Kathy Road last weekend.
Nathaniel James Tate, 37, and Jerry Jerome Benjamin, 53, and a juvenile are now in custody.
The U.S. Marshals Carolinas Regional Fugitive Task Force assisted in apprehending the suspects. The Burke County Sheriff's Office obtained warrants for their arrests on Thursday, June 5, after consulting with the district attorney's office.
An arrest was caught on camera Thursday as it occurred on North Green Street, near the former Walgreens.
These warrants are tied to their involvement with the shooting on last Saturday, May 31. There were three victims in the shooting, including Gregory Adonis Rutherford, 34, who was pronounced dead at UNC Health Blue Ridge. Jerry Benjamin was transported by Burke EMS to UNC Health Blue Ridge. Jonathan Michael Benjamin, 24, was hurt but declined medical attention.Â
Tate was charged with attempted first degree murder and Jerry Benjamin was charged with discharging a firearm into an occupied property.Â
Both men were not given a bond during their first appearance court date today, June 6. Their next court date is on Friday, June 27.Â
